“They have been served a notice under Section 41A of the CrPC to appear before the investigating officer on Monday,” said a senior officer.

“This, of course, is a deliberate misuse of the administrative machinery by the
Trinamul Congress dispensation. We are considering moving court,” said the
BJP’s Siliguri MLA, Sankar Ghosh.

Allegations have surfaced that some BJP MLAs had disrupted the singing of the National Anthem by Trinamul MLAs in the compound of the state Assembly on Wednesday and Thursday.

The BJP MLAs had allegedly shouted “chor chor (thief thief)” disrupting the singing of the anthem, the Trinamul has alleged.

The complaint submitted by the Trinamul leaders includes the name of the leader of the Opposition, Suvendu Adhikari, but the police have refrained from including his name in the FIR citing a court order.

Two complaints were lodged by Trinamul Congress MLAs on consecutive days.

The first complaint is said to have been triggered by an incident on Wednesday when chief minister Mamata Banerjee, along with several Trinamul MLAs, was holding a planned protest under B.R. Ambedkar’s statue in the Assembly compound.

The second complaint names seven BJP MLAs accusing them of a similar offence.
