Supreme Court deletes Bansuri Swaraj's name from order granting bail to AAP leader Sanjay Singh

Enforcement Directorate said BJP candidate's name got added to list of advocates 'erroneously'

The Supreme Court on Wednesday deleted the name of Bansuri Swaraj, the BJP candidate from the New Delhi Lok Sabha constituency, from its order granting bail to AAP leader Sanjay Singh after the Enforcement Directorate said her name got added to the list of advocates "erroneously".

Bansuri, the daughter of late BJP leader Sushma Swaraj, is a practising advocate of the Supreme Court.

On Tuesday, the bench of Justices Sanjiv Khanna, Dipankar Datta and P.B. Varale had directed Singh’s release on bail after the ED said it no longer required his custodial presence. Singh had been in Tihar jail following his arrest in October in connection with the excise policy scam.

During the morning mentioning time on Wednesday, advocate Zoheb Hossain, representing the ED, urged the bench to delete Bansuri's name from the list of advocates who appeared for the agency on Tuesday.

Hossain told the bench that Bansuri's name was “erroneously” mentioned in the list of the central government panel of advocates who represented the ED in the matter.

According to the corrected official order uploaded on Wednesday night, the counsels who appeared for the ED were Suryaprakash V. Raju, A.S.G. Mukesh Kumar Maroria, advocate-on-record Zoheb Hossain, Annam Venkatesh, Kanu Agarwal and Arkaj Kumar.

Bansuri's name, which was there in the original official order passed on Tuesday night, was subsequently deleted.

The corrected version added a footnote that said: "Revised (only Record of Proceedings) for the purpose of appearance only on the directions of Hon’ble Court upon mention being made on 03.04.2024. No change in the signed order.”
